Guide of 4 EPS Major Insurances

• Application and claim procedure for four major insurances under EPS
• What is the 4 major insurances of the Employment Permit
  System the four insurance policies (Departure Guarantee Insurance, Guarantee Insurance, Return Cost
  Insurance, and Casualty Insurance) that foreign workers and their employers must subscribed based on
• "The Act on the Employment of Foreign Workers, etc."

Application period

• Join the insurance within 80 days from the effective date of labor contract Insurance fee
  (Category 1) China, The Philippine, Indonesia, Thailand, Vietnam : 400,000 KRW
  (Category 2) Mongol, Kyrgyzstan, Other countries : 500,000 KRW
  (Category 3) Sri Lanka : 600,000 KRW
  ※ Insurance fee is flexible depending on air fare cost and etc.

Application procedure

• Sign Return Cost Insurance Agreement at the Employment Training center
  Pay the insurance fee to the bank account written on the Insurance Agreement within 80 days from he effective date(entry date) of labor contract
• Application document
1 copy of Insurance Agreement(distributed in the Employment Training center)

Reasons for payment claim

• When he/she intends to depart Korea because his/her sojourn period has expired When foreign workers intends to
  depart Korea for personal reasons before the expiration of his/her sojourn period (Excluding temporary departures);
• or When he/she has left his/her workplace without permission and intends to voluntarily leave Korea or is deported
• by the government of Korea.

Payment claim procedure

• Submit Departure Schedule Confirmation Form to the Job Center one month prior to the scheduled departure date.
  Submit 1 copy of the Application Form for Insurance Claim, 1 copy of the bankbook in the foreign worker's name and
• 1 copy of identification certification to Samsung Fire & Marine Insurance Co., Ltd.

Mandatory purchaser

• Foreign workers who entered Korea with non-professional employment visa(E-9)
  Application period
  Join the insurance within 15 days from the effective date of labor contract
  Insurance premium
  The amount announced by the Minister of Ministry of Labor in case of death or disease
  Application procedure
  Sign the Agreement at the Employment Training center and pay the fee (one time payment only for 3 years)

Report causes for payment claim

• Employers shall submit Foreign Employment Workplace Change Application to Job Center under MOEL when foreign
• workers are deceased or injured.

Report causes for payment claim

• Apply for the payment claim to Samsung Fire & Marine Insurance Co., Ltd. in case of foreign workers' casualty
• accident(disease) Apply for the payment claim to Samsung Fire & Marine Insurance Co., Ltd. in case of death with the
• reasons except for accident during work(1. it is also possible for the bereaved family to directly apply)

Required document

• 1 copy of claim application , 1 copy of passport or foreigners registration card, 1 copy of bank passbook(Proxy of attorney of named by the foreign worker or the bereaved, certificate of the bereaved, proving document of accident(death certificate or medical certificate of injury)

     Saving the amount as retirement pay per month based on the wage stated on labor contract Insurance premium

     = retirement  pay-insurance fee 
 

Mandatory purchaser

• Companies with more than one regular employee are subject to mandatory subscription to the insurance for the workers' severance payment within the 15days of the contract effectuation. Employer hiring foreign workers with a remaining contract of more than a year.

Application period

• Join the insurance within 15 days from the effective date of labor contract

Required document

• 1 copy of insurance agreement, 1 copy of automatic withdrawal application form, 1 copy of bank passbook(named of employers or of corporation)

Refund(employer)

• Foreign worker's desert or working less than 1 year → Employers submit Employment Change Application Form to the Job Center → submit Payment Claim Application Form to Samsung Fire & Marine Insurance Co., Refund(foreign worker) If departing to home country after working for over 1 year without desertion : foreign workers submit Departure Schedule Confirmation Form to the Job Center → submit Payment Claim Application Form to Samsung Fire & Marine Insurance Co., Ltd. If changing workplace after working for over 1 year : foreign workers shall submit Workplace Change Application Form to the Job Center → foreign workers submit Payment Claim Application Form to Samsung Fire & Marine Insurance Co., Ltd.

     Cover unpaid wages(maximum 2,000,000 KRW stated on the Standards Labor Contract and file an administrative

     litigation of difference wages
 

Mandatory purchaser

• Employer or workplace hiring less than 300 regular employees
• Employer or workplace not complied by Wage Claim Guarantee Act

Application period

• Join the insurance within 15 days from the effective date of labor contract

Application document

• 1 copy of License & Permit Bonds Application Form

Payment of foreign workers

• Notifies unpaid wage to the Ministry of Employment and Labor and verify the fact → Cancel the labor contract due to overdue wage and change workplace → file a claim with Seoul Guarantee Insurance Co., Ltd. → Paid from Seoul Guarantee Insurance Co., Ltd.

Refund(employer)

• If the contract expired due to foreign workers' desertion, departure and ect., without overdue wage, not passed insurance payment will be refunded excluding passed insurance premium
  ※ request branch offices of Seoul Guarantee Insurance Co., Ltd. with refund request form, passport or foreigners
     registration card, seal registered, certificate of seal
